1. Land
Land Registration: Upon acquiring land, it is necessary to pay the registration charges. It is advisable to register the land under the name of the company you intend to use for setting up the hospital. The cost of registry varies from state to state, typically ranging from 4-7% of the circle rates specified in the area.
Mutation: It is crucial to have your name recorded in the land records, as the registration process alone does not automatically update the ownership details in the land records. You will need to apply for a mutation to reflect the change in ownership.
Conversion: Land use is usually restricted and categorized as agricultural, commercial, or residential. Some states have specific land usage regulations for hospitals. In order to construct a hospital, you must obtain a land-use change to either commercial or hospital category, as per the local laws. This process is known as conversion.
2. Building
Approval of Building Plans: The relevant authority responsible for the location of the land grants approval for the building plans. This authority could be a development authority, municipality, panchayat, or any other governing body having jurisdiction over the land. Once the construction is completed, the same authority issues a Building Completion/Occupancy certificate. In certain special development zones, additional approvals may be required.
Fire NOC: A No Objection Certificate (NOC) from the fire department is necessary both before construction begins and upon completion of the building. The fire department typically follows the National Building Code 2016, although some states may adhere to NBC 2006 or 2016.
Pollution Control Board (PCB): Both pre- and post-construction NOC and licenses are required from the Pollution Control Board. The placement of wastewater treatment and biomedical waste disposal systems must comply with PCB regulations.
If the Land is Located on a National Highway: Permission from the National Highway authority is required for entry onto the highway.
AERB: The Atomic Energy Regulatory Board (AERB) issues an NOC and license for the installation of radiation equipment such as CT scanners, X-ray machines, and linear accelerators. The construction of the building must adhere to specific wall and space requirements specified by AERB.
Clinical Establishment (CE) License: Health is a state subject and hence all the states have different CE acts and requirements to be followed.
PNDT License
Pharmacy License, Narcotic Drugs, and Other Drugs Related Licenses.
Lift, DG, and other Miscellaneous Licenses.
NABH and NABL Accreditation: Hospital is planned following the norms specified in NABH.
